Job Protections and Benefit Payment Schedules
Minnesota's Paid Leave law will help individuals take time off when they need to care for themselves or their loved ones. The Minnesota Legislature passed Paid Leave into law in 2023 and charged the Minnesota Department of Employment and Economic Development (DEED) with managing the Paid Leave program. Additionally, the Legislature delegated authority to DEED to make rules necessary to carry out the Paid Leave program. Rulemaking in Minnesota follows procedures outlined in the Minnesota Administrative Procedure Act in Minn. Stat. Chap.14.
The Paid Leave division is in the process of drafting the rules. Draft rules will be posted on this website as they become available. Draft rules are for discussion and feedback purposes only and are not officially adopted or proposed rules.
The draft rules are currently expected to fall into these categories: Opting In, Private Plans, Seasonal Hospitality Employment, Health Care Provider Certification, Safety Leave, Claims Administration, Role of the Employer, Small Employers, Covered Employment, and Job Protections.
The Paid Leave division is gathering public input and feedback on draft rules.
Comment through the Office of Administrative Hearings
The public can comment directly through the Office of Administrative Hearings website: Office of Administrative Hearings Comments On Rules (granicusideas.com). Comments received are public and will be available for review at the OAH Rulemaking eComments website.
Attend a Virtual Listening Session
You can provide feedback on proposed rules by attending a virtual listening session.
